Payment Policies & Absences

Registration: Non-refundable $95 fee is due at sign up when enrolling your child, or yourself for swim lessons. The registration fee is charged once per family, per calendar year and applies to the year in which your enrolled session takes place. If you register in advance for a session beginning in the following calendar year, the registration fee for that upcoming year will be due at the time of enrollment. The registration fee does not go towards the tuition of swim lessons themselves.

Payment: Is due bi-weekly and in advance before lessons are received, or time slots are secured. (This is a 10 week program and the “weekly” tuition fee is $250 per student/per week.) Once you have registered, you will be contacted by one of our representatives to select an available lesson time. You will then have 48 hours to make your first bi-weekly payment, plus the registration fee. If payment is not received, you will lose your chosen time slot. Initial payments are made using Venmo, Zelle or Credit Card.

Bi-Weekly Tuition & Late Payment Policy: Bi-weekly tuition payments are due on Thursdays, prior to lessons being held the following week. Payments no made by the Thursday due date will incur an immediate $40 late fee, which will be added to the next billing cycle. If payment is not received in full by Sunday, lessons scheduled for the following Monday will be suspended until the account is brought up to date.

Attendance/Cancellation: You are paying for your time-slot regardless of how many times you are able to attend swim lessons. There are no free makeup lessons for absences including, but not limited to illness or vacation. Consistent participation is crucial to the success of every swimmer. Perfect attendance will increase the rate of progress through the lessons and retention of the skills. * Instructor cancellations due to unexpected pool malfunctions, inclement weather, or an emergency… will be rescheduled for that Friday.

Assumption of Risk
I understand and acknowledge that participation in Swim Synergy, Inc. programs may be hazardous and involves inherent risks associated with swimming, diving, and other strenuous physical activities. I also understand that lessons may take place at privately owned residential properties, and that entering and using the property and pool area may involve typical conditions such as stairs, decks, varying water depths, pool features (including Baja shelves), and surrounding hardscape. With this understanding, I voluntarily assume all ordinary risks associated with participation and use of the premises and agree to comply with all stated and customary rules, instructions, and safety guidelines. If I observe any unusual or significant hazard, I agree to remove myself or my child from participation and promptly notify Swim Synergy. To the fullest extent permitted under California law, I release, waive, and hold harmless Swim Synergy, Inc., its owners, employees, and instructors, as well as the private property owners hosting lessons, from any claims arising out of participation or use of the premises, except to the extent caused by gross negligence or willful misconduct, and I agree to indemnify them from any claims brought on behalf of myself or my child, including those brought by heirs, representatives, or assigns. I further represent that, to the best of my knowledge, neither I nor my child has any medical, physical, or emotional condition that would hinder or prevent safe participation in Swim Synergy, Inc. programs.

Except as expressly authorized by Swim Synergy in writing, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from such materials or content Use of the content or materials for any purpose not expressly permitted in these Terms of Use is prohibited. Any rights not expressly granted herein are reserved. Limitation of Liability IN NO EVENT SHALL SWIM SYNERGY, NOR ITS DIRECTORS, EMPLOYEES, AGENTS, POOL HOSTS, CONTRACTORS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL THEORY WITH RESPECT TO OUR SERVICES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR BODILY INJURY, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. Indemnification You agree to defend, indemnify and hold harmless Swim Synergy, Inc., its affiliates and their employees, contractors, officers, pool hosts, directors, and representatives from all liabilities, claims, and expenses, including attorneys’ fees that arise from your use of our services. Swim Synergy, Inc. reserves the right, at its own expense, to assume the exclusive.
Photo/Video Release
As the parent or legal guardian of the child or children I am enrolling in Swim Synergy lessons; I hereby grant permission to Swim Synergy, the rights of any images, in video or still, and of the likeness and sound of their voice as recorded on audio or videotape without payment or any other consideration. I understand that their image may be edited, copied, exhibited, published or distributed and waive the right to inspect, or approve the finished product wherein their likeness appears. Additionally, I waive any right to royalties or other compensation arising, or related to the use of their image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area. Photographic, audio or video recordings may be used for ANY USE which may include but is not limited to: Presentations; Courses; Online/Internet Videos; Media; News (Press); Social Media Photos and videos taken during lessons are never without prior parental or legal guardian consent, or without direct supervision of said parent/legal guardian. Photos and videos are shared with parents upon request and are best shared when Swim Synergy is provided with a memory stick. By signing this release, I understand this permission signifies that photographic or video recordings of my child or children may be electronically displayed via the Internet or in the public educational setting. I will be consulted about the use of the photographs or video recording for any purpose other than those listed above. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document only. By signing this release, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against Swim Synergy.
