We collect personal information that you voluntarily provide to us when you register on the Services, express and interest in obtaining information about us or our products & Services, when you participate in activities on the Services, or otherwise when you contact us.

Despite this, no system may be guaranteed to be 100% secure and as such we cannot guarantee that personal information will not be subject to unauthorized access in the event of cyberattack. Any personal information provided assumes this risk and the user submits any personal information at their own risk.

  1. Do We Collect Information From Minors

We do not knowingly solicit data from or market to persons under the age of 18. By using the Services you represent that you are at least 18 years of age or that you are the parent or guardian of such a minor and consent to the minor’s use of the Services. If we learn that personal data has been collected about a user less than 18 years of age, the data shall be deleted and the user account shall be deactivated.

Additionally, please note that this will no affect processing your information in situations where consent is not required, i.e. legal or regulatory requirements.

Opting out of marketing and promotional communications: you can unsubscribe from our marketing and promotional communications at any time by clicking on the provided unsubscribe link in the emails we send or by contacting us using the contact details provided below. You will then be removed from marketing lists, however, we may still communicate with you for Service-related messages that are necessary to the administration and use of your account, to respond to your requests, or other non-marketing related contact.

Account Information: you may review or change the information in your account or terminate your account by logging into your account settings and selecting update user account, or like terms. Upon a request to terminate your account, we will deactivate or delete your account information in our active databases. Data will be retained as described above.

  1. Controls For Do-Not-Track Features

Most browsers and some mobile operating systems and applications allow for Do-Not-Track (“DNT”) features or settings to signal your privacy preference that you wish to not have your data collected and do not want to utilize online browsing activity monitoring. At this stage, no uniform technology standard for DNT exists. As such, we currently do not respond to DNT or similar signals. If such a standard is adopted in the future, an update to this policy will be communicated.

California Civil Code §1798.83 permits users who are California residents to request and obtain a once yearly, free of charge copy of their information, categories of personal information (if any) that are disclosed to third parties for marketing purposes, and the names and contact information for such third parties. CCPA Privacy Notice:

The California Code of Regulations defines a “resident” as:

  1. Every individual in the state of California for other than a temporary or transitory purpose and
  2. Every individual who is domiciled in the state of California who is outside the state of California for a temporary or transitory purpose.

All other individuals are defined as “non-residents.”

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”).     • Examples: Access history and information on your interaction with our application.
  6. Category G – Geolocation Data
    • Examples: Device Location
  7. Category H – Audio, electronic, visual, thermal, olfactory, or similar information
    • Examples: images and audio, video or call recordings created in connection with our business activities.
  8. Category I – Professional or employment-related information
    • Examples: Occupation, employer information.
  9. Category J – Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99))
    • Examples: Education level, school attended.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from our clients or their agents. For example, from information our clients provide to us related to the Services for which they engage us.
  • Directly from you. For example, through information we ask from you when our clients or their agents subscribe and engage our Services.
  • Directly and indirectly from you when using our Services or visiting our website. For example, usage details collected automatically in the course of your interaction with our platform or website.

Use of Personal Information:

We may use or disclose the personal information we collect for one or more of the following business purposes:

  1. To fulfill or meet the reason for which the information is provided. For example, to submit this information to our clients or their agents in the form of insurance application forms or request for information.

When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have not sold any personal information.

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights:

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  2. Our business or commercial purpose for collecting that personal information.
  3. The categories of third parties with whom we share that personal information.

Deletion Request Rights:

You have the right to request that we delete any of your personal information we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights:

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by email at Info@swimsynergy.com.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  1. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format:

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to the registered email associated with the account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination:

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  1. Deny you use of our Services.
  2. Provide you a different level or quality of Services.

We reserve the right to amend this Privacy Notice at our discretion and at any time. The date this Privacy Notice was last updated is identified at the bottom of this page.
